Public offer of a voluntary charitable donation
This offer is addressed to an indefinite number of persons – individuals and legal entities – visitors to the website on the Internet: http://imm.net.ua/ (hereinafter referred to as the “Site”), hereinafter referred to as the “Benefactor”, and is an official and public offer of the Israeli Medical Mission Charitable Foundation, hereinafter referred to as the “Foundation”, represented by the Chairman of the Board Andriy Kozlenko, acting on the basis of the Charter, to enter into a charitable donation agreement (hereinafter referred to as the “Agreement”), the subject and essential terms of which are set forth below:
1. Terms and definitions:
Acceptance – full and unconditional acceptance of the Public Offer by taking actions to make a money transfer using the payment forms and means posted on the Site, as well as by transferring funds to the current account of the Foundation through bank institutions. The date of Acceptance shall be the date of crediting funds to the Fund’s current account.
Payment is a voluntary charitable donation.
A voluntary charitable donation is a money transfer made by the Donor to achieve the goals, objectives, directions and types of statutory activities of the Foundation in accordance with the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
2. Subject of the Agreement:
The subject matter of this Agreement is the donation by the Donor to the Foundation of funds to achieve the goals, objectives, directions and types of the Foundation’s statutory activities.
Acceptance of the Agreement means that the Donor agrees with all its provisions, he/she is fully aware of the subject matter of the Agreement and the purpose of collecting donations.
The Agreement shall be concluded by the Donor’s unconditional and full accession to this Agreement and acceptance of all material terms of the Agreement.
The Donor and the Foundation, guided by Art. 207, Part 2 of Art. 639, Art. 641, 642 of the Civil Code of Ukraine, Art. 7 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”, agree that the Agreement shall be deemed concluded in writing without signing a written copy by the Parties from the moment the Donor performs the actions provided for by the Agreement, which indicate the consent to comply with the terms of the Agreement.
The Agreement is posted on the website http://imm.net.ua/ in a freely accessible manner and in a way that ensures that every person applying to the Foundation is familiarized with the content of this Agreement.
The Benefactor may not offer its own terms of the Agreement.
3. Rights and Obligations of the Parties:
The Foundation has the right to:
– Receive voluntary charitable donations and use them to achieve the goals, objectives, directions and types of the Foundation’s statutory activities in accordance with the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
– At the request of the Donor, provide a report on the voluntary charitable donation received and its use.
The Donor has the right to:
– Transfer a voluntary charitable donation to the Foundation’s account in the manner specified in the Agreement;
– Request a report on the use of the voluntary charitable donation.
4. Place of fundraising:
Voluntary charitable donations may be collected in any country of the world.
5. Fundraising period:
The collection of voluntary charitable donations continues until the liquidation of the Foundation, unless another term is determined by the Foundation.
6. Procedure for public access to the Foundation’s reports
Access to the Foundation’s reports is provided by posting them on the Website in the section “Documents and Reports of the Foundation”.
Other information may be provided by the Fund in accordance with the procedure and within the terms provided for by the legislation of Ukraine.
7. The Donor shall bear all expenses related to the transfer of the donation.
8. Other conditions
The Donor independently determines the amount of a voluntary charitable donation.
The donation is voluntary and non-refundable.
The Donor is responsible for the accuracy of the information provided when transferring the Donation.
In order to comply with the Law of Ukraine “On Personal Data Protection” and to properly fulfill the terms of the Agreement, the Donor agrees to the processing of personal data.
The provisions of Ukrainian legislation shall apply to the relationship between the Donor and the Foundation.
